These Terms of Service (“Terms”) are a legal agreement between you and Kickoff Youth Soccer Consulting LLC (“Kickoff,” “we,” “us,” or “our”) governing your use of our website, mobile app, content, and AI features (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is intended for competitive youth soccer players and is designed to be used with the involvement of a parent or legal guardian. You must be at least 13 years old to create an account. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf, is responsible for your account, and consents to your participation. By agreeing to these Terms, you represent that you are 18 or older, or that you are the parent or legal guardian of the player and agree on their behalf.
You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
The Service — including training programs, nutrition guidance, and the AI Coach — provides general educational content only and is not medical, healthcare, dietary, or other professional advice, and is not a substitute for a qualified coach, physician, or registered dietitian. Physical training carries inherent risks, including the risk of injury. By using the Service you (and, for a minor, the parent or guardian) voluntarily assume those risks. Consult a physician before beginning any exercise or nutrition program, especially with any injury or medical condition, confirm the participant is medically cleared, and stop and seek care if you feel pain, dizziness, chest pain, or shortness of breath. The Service is not for emergencies — call your local emergency number.
The AI Coach generates responses from Kickoff’s content and can be incomplete, inaccurate, or out of date. It is general education, not professional, medical, or safety advice, and you should not rely on it for medical, injury, or safety decisions. Verify important information with a qualified professional.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial educational use while your subscription is active. You will not copy, reproduce, download, record, share, distribute, sell, modify, create derivative works from, publicly display, or use in a group/commercial/institutional setting any part of the Service or its content, and you will not scrape or use automated tools to access it. All content is the exclusive property of Kickoff or its licensors and is protected by intellectual-property laws. Additional terms in the subscriber agreement presented at checkout also apply.
The Service and all content are provided “as is” and “as available.” To the maximum extent permitted by law, Kickoff disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or produce any particular result.
To the maximum extent permitted by law, Kickoff and its owners, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury arising from your use of the Service. Kickoff’s total liability for any claim related to the Service will not exceed the greater of the amount you paid Kickoff in the twelve months before the claim or one hundred U.S. dollars.
You agree to indemnify, defend, and hold harmless Kickoff and its owners, officers, employees, contractors, and affiliates from any claims, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or, for a parent or guardian, the use of the Service by a minor in your care.
You may stop using the Service at any time and delete your account in the app. We may suspend or terminate your access for any violation of these Terms or to protect the Service or other users. Sections intended to survive termination (including Sections 3, 7, 8, and 9) will continue to apply.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. To the extent permitted by applicable law, any dispute arising from these Terms or the Service will be resolved by binding individual arbitration, and you and Kickoff waive the right to a jury trial and to participate in a class action. Where arbitration is not permitted (including certain matters involving minors), disputes will be resolved exclusively in the state or federal courts located in Delaware.
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, where appropriate, notify you within the Service. Your continued use after changes take effect means you accept the updated Terms.
